Please read these Terms of Use carefully before accessing or using the Yulvenus platform. By accessing or using any part of the platform, you agree to be bound by these terms. If you do not agree to all terms and conditions, you may not access the platform or use any services.
1. Acceptance of Terms
These Terms of Use constitute a legally binding agreement between you and Yulvenus governing your access to and use of the website located at yulvenus.com, including all content, functionality, and services offered on or through the platform.
By registering an account, purchasing a course or session, or otherwise interacting with the platform, you confirm that you are at least 18 years of age, or that you have obtained verifiable parental or guardian consent if you are a minor in your jurisdiction, and that you have the legal capacity to enter into this agreement.
2. Definitions
- Platform — the Yulvenus website, mobile applications, and related digital services.
- User — any individual who accesses or uses the platform, whether registered or not.
- Learner — a registered user who enrolls in courses, sessions, or learning paths.
- Instructor — a registered user who creates, delivers, or facilitates educational content or sessions.
- Content — all text, images, video, audio, interactive materials, assessments, and other materials available on the platform.
- Session — a scheduled group or individual live interaction between a learner and an instructor.
- Account — a registered user profile created on the platform.
3. User Accounts
3.1 Registration
To access most features of the platform, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify us immediately at support@yulvenus.com if you suspect any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time, without prior notice, if we determine that you have violated these Terms of Use or if your account has been inactive for an extended period. You may also request account deletion by contacting our support team.
4. Platform Services
4.1 Educational Content
Yulvenus provides access to educational materials, courses, and resources focused on color analysis and related subjects. Content is made available for personal, non-commercial educational use only.
4.2 Group and Individual Sessions
The platform facilitates both group learning sessions and private one-on-one interactions with instructors. Session availability, scheduling, and capacity are subject to change without notice. Confirmed session bookings are subject to the cancellation policy described in Section 9.
4.3 Personalized Learning Paths
Certain features of the platform may generate personalized recommendations or learning path suggestions based on your activity, preferences, or assessment results. These recommendations are provided for guidance purposes only and do not constitute professional advice of any kind.
4.4 Service Availability
We strive to ensure the platform is available at all times but do not guarantee uninterrupted access. The platform may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We are not liable for any inconvenience or loss resulting from service interruptions.
5. Acceptable Use
5.1 Permitted Use
You may use the platform only for lawful purposes and in accordance with these Terms of Use. You agree to use the platform in a manner consistent with all applicable laws and regulations and respectful of other users and instructors.
5.2 Prohibited Activities
You agree not to engage in any of the following activities:
- Copying, reproducing, distributing, transmitting, or commercially exploiting any content from the platform without prior written authorization.
- Uploading or transmitting any harmful, offensive, defamatory, obscene, or otherwise objectionable material.
- Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
- Attempting to gain unauthorized access to any part of the platform, other user accounts, or server infrastructure.
- Using automated tools, bots, scrapers, or scripts to extract data from the platform without express written permission.
- Interfering with or disrupting the integrity or performance of the platform or its underlying systems.
- Recording, capturing, or redistributing live sessions without the explicit written consent of all participants and Yulvenus.
- Posting spam, unsolicited promotional content, or engaging in any form of harassment toward other users or instructors.
- Circumventing, disabling, or otherwise interfering with security-related features of the platform.
6. Intellectual Property
6.1 Platform Ownership
All content, features, and functionality of the platform, including but not limited to text, graphics, logos, icons, images, video materials, software, and design elements, are the exclusive property of Yulvenus or its content licensors and are protected by applicable intellectual property laws.
6.2 Limited License
Subject to your compliance with these Terms of Use, Yulvenus grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform and its content solely for your personal, non-commercial educational purposes. This license does not include any right to sublicense, sell, resell, transfer, or otherwise exploit any platform content.
6.3 User-Submitted Content
By submitting, posting, or sharing any content on the platform — including forum posts, assignments, feedback, or other materials — you grant Yulvenus a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, and display such content in connection with the operation and promotion of the platform. You represent and warrant that you own or have the necessary rights to submit such content and that it does not infringe any third-party rights.
6.4 Instructor Content
Instructors who create and publish educational materials on the platform retain ownership of their original content. By publishing content on the platform, instructors grant Yulvenus a license to host, display, and distribute such content to enrolled learners in accordance with the applicable instructor agreement.
7. Payments and Billing
7.1 Pricing
Fees for courses, sessions, and subscriptions are displayed on the platform at the time of purchase. All prices are listed inclusive of applicable taxes where required. We reserve the right to change pricing at any time, and such changes will take effect upon posting to the platform.
7.2 Payment Processing
Payments are processed through third-party payment service providers. By submitting payment information, you authorize us to charge the applicable fees to your designated payment method. We do not store your full payment card details on our servers.
7.3 Subscription Services
Where subscription access is offered, your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date. You may manage your subscription settings through your account dashboard or by contacting support.
8. Refunds
Refund eligibility is determined by the nature of the purchase and the extent to which services have been consumed. As a general policy:
- Requests for refunds on self-paced course purchases must be submitted within 7 days of purchase and prior to completing more than 20% of the course content.
- Refunds for live individual or group sessions are subject to the cancellation terms described in Section 9.
- Subscription fees for a current billing period are generally non-refundable once the billing cycle has begun.
To request a refund, contact us at support@yulvenus.com with your order details. We reserve the right to deny refund requests that do not meet the stated eligibility criteria.
9. Session Cancellations and Rescheduling
For booked live sessions, the following terms apply:
- Cancellations made more than 24 hours before the scheduled session start time are eligible for a full credit or refund.
- Cancellations made within 24 hours of the session start time may not be eligible for a refund but may be rescheduled at the discretion of the instructor.
- In the event that an instructor cancels a session, affected learners will receive a full credit or refund.
- Repeated no-shows or late cancellations may result in restrictions on future booking privileges.
10. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. By using the platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. We encourage you to review the Privacy Policy to understand our data practices.
11. Third-Party Links and Services
The platform may contain links to third-party websites, tools, or services that are not owned or controlled by Yulvenus. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We do not endorse or guarantee the accuracy of any third-party content. You access third-party resources at your own risk and subject to the terms of those third parties.
12. Disclaimers
12.1 No Professional Advice
All content provided on the platform is for educational and informational purposes only. Nothing on the platform constitutes professional advice of any kind, including but not limited to medical, psychological, legal, or financial advice. You should seek independent professional guidance for matters requiring specialized expertise.
12.2 No Warranty
The platform and all content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the platform will be error-free, uninterrupted, secure, or free of viruses or other harmful components.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Yulvenus and its officers, directors, employees, affiliates, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or service interruption, arising out of or in connection with your use of or inability to use the platform, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claims arising under or related to these Terms of Use shall not exceed the total amount you paid to Yulvenus in the twelve months preceding the claim.
14. Indemnification
You agree to defend, indemnify, and hold harmless Yulvenus and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including reasonable legal fees, arising out of or relating to your violation of these Terms of Use, your use of the platform, your submission of content, or your violation of any rights of any third party.
15. Modifications to Terms
We reserve the right to modify these Terms of Use at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify registered users via email or an in-platform notification. Your continued use of the platform after the effective date of any changes constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you must discontinue use of the platform.
16. Modifications to the Platform
We reserve the right to modify, suspend, or discontinue any part of the platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the platform or any service offered through it.
17. Governing Principles
These Terms of Use are intended to be interpreted in a manner consistent with fair dealing, good faith, and internationally recognized principles of electronic commerce and online education services. Any disputes arising from these terms shall be resolved through good-faith negotiation in the first instance, followed by mediation or arbitration where negotiation fails.
18. Severability
If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these terms.
19. Entire Agreement
These Terms of Use, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Yulvenus with respect to your use of the platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
